Terms of Service

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally capable of entering into a binding contract to use the Services. By using the Services, you represent that you meet these requirements.

2. Accounts

Certain features (e.g. the client portal, paid newsletter tiers, purchased blueprints) require an account. You are responsible for keeping your credentials secure and for all activity that occurs under your account. Notify us immediately at hector@htek.dev if you suspect unauthorized access.

3. Content on the Site

Articles, code samples, diagrams, and other free content on the Site are published for educational and informational purposes. Unless otherwise noted, you may share and quote excerpts with attribution and a link back to the original article. Bulk republication, training of AI/ML models on the corpus, or commercial redistribution without prior written permission is not permitted.

4. Newsletter

The free newsletter is provided as-is and you can unsubscribe at any time using the link in any email. Paid newsletter tiers are billed via Stripe at the price and cadence shown at checkout. You may cancel paid subscriptions at any time; access continues through the end of the current billing period and no refunds are issued for partial periods unless required by law.

5. Blueprints and Digital Products

Blueprints and other downloadable digital products are licensed to you for your own use (personal or within a single organization, as specified at purchase). You may not resell, sublicense, or redistribute the products. Because digital products are delivered immediately upon purchase, sales are final and non-refundable except where required by law or where we determine, at our sole discretion, that a refund is appropriate.

6. Consulting and Advisory Services

Any consulting, advisory, audit (including the Delivery Confidence Audit), or custom development engagement is governed by a separate written statement of work ("SOW") executed by both parties. In the event of any conflict between these Terms and an executed SOW, the SOW controls for that engagement.

Recommendations, code, configurations, and other deliverables provided through the Services are advisory in nature. You are responsible for reviewing and testing them before applying them to your systems.

7. Acceptable Use

You agree not to:

• Use the Services to violate any law or the rights of others.
• Attempt to gain unauthorized access to the Services, other users' accounts, or any underlying infrastructure.
• Interfere with the operation of the Services (e.g. via denial-of-service attacks, malware, or excessive automated scraping).
• Scrape, crawl, or otherwise systematically harvest content for use in training AI/ML models without prior written permission.
• Use the Services to send spam, harassment, or unlawful content.

8. Intellectual Property

All Site content (other than your own contributions and third-party content explicitly marked as such) is owned by Hector Flores or licensed to us. The "htek.dev" name and logo are our marks. You receive no ownership rights by using the Services — only the limited rights expressly described in these Terms.

9. Third-Party Links and Services

The Site links to third-party tools, platforms, and articles. We do not control those resources and are not responsible for their content, terms, or privacy practices. Your use of any third-party service is subject to that party's terms.

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Hector Flores and htek.dev from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Services, or your violation of any third-party right.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or if continued provision of the Services to you would expose us to legal or operational risk. Sections that by their nature should survive termination (e.g. Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will survive.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced on this page with a new effective date. Continued use of the Services after the new effective date constitutes acceptance of the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction to protect its intellectual property rights.

16. Miscellaneous

These Terms (together with any applicable SOW and our Privacy Policy) constitute the entire agreement between you and htek.dev regarding the Services. If any provision is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our prior written consent; we may assign them in connection with a sale or reorganization of the business.
